SUMMARY:Data Protection\, Competition and Consumer Law Interplay in a Data-Driven Economy: Evidence from Ukraine and Norway
DESCRIPTION:This seminar seeks to foster critical discussion among scholars\, practitioners and regulatory experts on the legal and institutional frameworks governing digital markets\, with the aim of gaining insights from Norway. Speakers from Ukraine will address the challenges of war for the data-driven economy and the impact of data protection and competition law. This will be followed by a round of reflections from a Norwegian perspective. \nPROGRAMME\nWar and the Data-Driven Economy: Challenges and Solutions \nDr. Liudmyla Petrenko \n\nProfessor\, Department of Business Economics and Entrepreneurship\, Kyiv National Economic University after Vadym Hetman (KNEU); Visiting scholar at the Max Planck Institute for Innovation and Competition (Munich\, Germany)\, 2022-2025\n\n \nThe presentation examines how Ukrainian digital platforms have strategically leveraged user data\, regulatory frameworks\, and innovative governance models to drive business growth and resilience in wartime conditions. Drawing on recent trends: The e-commerce market rose to nearly $4 billion in 2024\, marking a ~30% YoY increase\, driven by digital payments\, mobile commerce\, and omnichannel approaches. The IT and fintech sector\, contributing almost 5% to GDP\, reached $8 billion in revenue in 2023\, underscoring the sector’s economic significance. The analysis emphasizes how digital technologies facilitated economic continuity\, enabling remote work\, sustaining export revenues\, and supporting domestic consumption through innovative online platforms. Additionally\, it addresses significant challenges\, such as infrastructure damage\, human capital loss\, and cybersecurity threats\, detailing Ukraine’s adaptive strategies including cloud migration\, international collaboration\, and enhanced digital governance. The study concludes by reflecting on how the crisis has accelerated digital transformation\, creating lasting structural changes and global integration opportunities vital for Ukraine’s post-war economic recovery. \nData Protection and Competition Law: Cross-Regulatory Solutions for Ukraine \nDr. Nataliia Mazaraki \n\nChair of the International\, civil and commercial law department\, State University of Trade and Economics\, Visiting scholar at the Max Planck Institute for Innovation and Competition (Munich\, Germany)\, 2022-2025\n\n \nThe analysis identifies opportunities for cross-regulatory cooperation between Ukraine’s competition authority and data protection agencies\, suggesting integrated regulatory approaches to effectively manage digital market power and safeguard personal data—essential components of Ukraine’s digital transformation and European integration. The research highlights cases and key regulatory trends in Ukrainian digital markets and data governance: (1) BlaBlaCar antitrust case (2025) – the Antimonopoly Committee of Ukraine (AMCU) fined the local operator approximately ₴424\,000 for failing to provide requested competition information\, marking the first enforcement action in the online P2P mobility sector and signaling broader scrutiny of digital platforms; (2) Kyiv Digital vs. MIA platform bias (2025) – AMCU issued formal recommendations to prevent state-led favoritism toward the MIA’s driving simulator app over private competitors\, reinforcing the application of competition rules to government-backed platforms. DESCRIPTION:I november 2020 forbød Konkurransetilsynet Schibsteds oppkjøp av Nettbil\, basert på at det ville medføre en betydelig begrensning i effektiv konkurranse i markedet. Konkurranseklagenemnda ga i mai 2021 Konkurransetilsynet medhold. Partene anket til Gulating lagmannsrett\, og de fikk i mars 2022 medhold. Staten anket saken inn for Høyesterett\, og Høyesterett forkastet i februar 2023 anken. Det var hovedsakelig basert på at Finn og Nettbils produkter ikke konkurrerte med hverandre. \nI dette seminaret ønsker vi å diskutere Finn/Nettbil saken\, og hvilke implikasjoner Høyesteretts dom får for fremtidige saker om foretakssammenslutninger. DESCRIPTION:Market investigation tool in Norway?\n \nIn recent years\, there has been an ongoing debate about new competition law tools that could complement existing competition law tools. In the EU both the Digital Markets Act (DMA) and the Digital Services Act (DSA) have been heavily debated. At the same time there are countries such as Iceland and United Kingdom that already for many years have had a competition tool called “market investigation”. This is a tool that makes it possible to investigate a particular industry\, and propose measures to correct any adverse effect on competition even if there is no established violation of the competition rules. Earlier this year\, the Norwegian Ministry for Industry and Fisheries proposed that the Norwegian Competition Authority should be given the authority to perform market investigations\, similar to the CMA’s model. So far such a new competition tool has not been implemented. The seminar invites to a discussion on the pros and cons of such a new competition tool. To do this\, we have three distinguished speakers: \n\nSenior Director Daniel Gordon\, Competition & Markets Authority\, United Kingdom\nSenior Advisor Hans-Petter Håvås Hanson\, Norwegian Competition Authority\nPartner Kristin Hjelmaas Valla\, Kvale law firm\n\nDaniel Gordon will explain the market investigation tool that has been used in the UK for many years\, while Hans-Petter Håvås Hanson will discuss the main reasons for introducing such a competition tool in Norway. Bakgrunnen for opprettelsen av arbeidsgruppen var at EFTAs overvåkningsorgan (ESA) mener at det offentliges skattefritak og konkursimmunitet bryter med EU/EØS-regler om offentlig støtte når det offentlige driver «økonomisk aktivitet» i konkurranse med private markedsaktører. \nRapporten «Like konkurransevilkår for offentlige og private aktører» ble overlevert Nærings- og fiskeridepartementet 23. januar 2018. I rapporten vurderte arbeidsgruppen to løsninger for å tilpasse seg reglene om statsstøtte: Et regnskapsmessig skille mellom økonomisk og ikke-økonomisk aktivitet og utskilling av økonomisk aktivitet. \nDet offentliges økonomiske aktivitet er uproblematisk så lenge staten eller kommuner driver på markedsmessige vilkår i henhold til det såkalte markedsaktørprinsippet (MEOP). MEOP innebærer at det offentlige handler på samme måte som en sammenlignbar\, rasjonell og profittorientert markedsaktør ville ha gjort under lignende omstendigheter. Arbeidsgruppen flertall foreslår å innføre et nasjonalt tilsynsorgan\, lagt til Konkurransetilsynet\, som skal overvåke etterlevelsen av det såkalte markedsaktørprinsippet. \nRapporten ble sendt på høring før regjeringen skal ta stilling til ESAs foreløpige konklusjonen om at det offentliges skattefritak og konkursimmunitet utgjør ulovlig statsstøtte. Det er mye som står på spill både for det offentlige\, som kan bli utsatt for en omfattende omorganisering\, og det private\, som forventer konkurranse på like vilkår. \nKonkurransen mellom det private og det offentlige er også et tema i Danmark\, hvor nasjonale regler om offentlig støtte er en del den danske konkurranseloven. Den danske regjeringen satte ned en tilsvarende arbeidsgruppe for å se nærmere på det som gjerne beskrives som «offentligt opgavetyveri».
