DESCRIPTION:BECCLE inviterer til seminar om økonomiske eksperters rolle i saker om erstatning for brudd på konkurransereglene den 16. april kl. 14:00 til 1530. Frode Steen (NHH og BECCLE) og Lars Sørgard (NHH og BECCLE) som begge har vært involvert i denne typen saker som ekspertvitner eller domstolsoppnevnte eksperter\, vil innlede om temaet. \nDet siste ti-året har vi sett en økt aktivitet hva angår erstatningssaker som følger av brudd på konkurranseloven. I slike saker er det krevende å beregne tapet for kundene som følge av bruddet på konkurransereglene. Anslag på tap som følge av konkurransebrudd\, i den grad det skal beregnes\, vil typisk bli gjort av økonomiske eksperter. I dette seminaret vil vi gjennom to eksempler belyse hvilken rolle økonomiske eksperter kan ha i erstatningssaker. Den ene saken omhandler ulovlig prissamarbeid i lastebilmarkedet i flere europeiske land\, en sak som har gått for retten i Norge. Den andre saken omhandler misbruk av dominans i markedet for elektrisk kraft i Danmark\, en sak som har gått for retten i Danmark. \n \n  \nFrode Steen er professor i samfunnsøkonomi ved Institutt for Samfunnsøkonomi på NHH\, og er nå leder for NHHs forskningsprogram FOOD på NHH som er finansiert av NorgesGruppen. Hans forskning og undervisning omhandler konkurranse\, og han har vært mye brukt som ekspertvitne i konkurransesaker. Han representerte Posten i erstatningssøksmålet mot det såkalte  lastebilkartellet som gikk for norske domstoler. \n \n  \nLars Sørgard er professor i samfunnsøkonomi ved NHH\, og hans forskning og undervisning omhandler konkurranse. Han var i perioden 2016-22 konkurransedirektør\, og var i perioden 2022-25 leder for BECCLE. SUMMARY:Private Enforcement of Competition Law
DESCRIPTION:Private enforcement of competition law\, particularly through damages actions\, has grown significantly across Europe over the past decade. Yet striking the right balance between effective public enforcement and safeguarding the rights of parties harmed by anticompetitive conduct remains a challenge. Despite important legislative initiatives\, such as the Damages Directive from 2014\, access to justice through national courts varies considerably across jurisdictions. \nA key reason is the lack of full harmonization. Procedural autonomy continues to allow divergent national approaches to issues such as litigation funding\, disclosure rules\, and the balance between protecting leniency applicants and enabling effective claimant actions. \n In this seminar\, BECCLE is proud to bring together leading practitioners and scholars in the field of competition law. The programme will provide insight into the current regulatory framework\, covering EU\, EEA\, and Norwegian perspectives\, and examine a broad range of issues related to private enforcement of competition law. One question that has been frequently discussed\, is whether the petrol price cycles that have been observed in many countries\, is a sign of competition or collusion. At this seminar\, Yiming Liu will discuss pricing behavior in petrol markets\, with a particular focus on how behavioral models can help us to understand the toughness of price competition in these markets. \nYiming Liu\, post doc at the Humboldt University of Berlin. \nTitle: Pricing in petrol markets\nSpeaker: Yiming Liu\, post doc at the University of Humboldt\nDate and time: November 18\, 12.15-13.30\nLocation: Department of Economics at NHH\, Room E209/E210 \nAbstract of paper:\nWe show how cognitive constraints systematically shape pricing behavior in a firm with over 20\,000 gas stations. Consistent with insights from behavioral models of bounded rationality\, station managers with lower cognitive skills have biased mental models. These underestimate competitor sophistication and competitor retaliation for price cuts\, and thus place more confidence in the efficacy and profitability of low prices. In the field\, managers with lower cognitive skills set lower prices\, and engage in more price wars. The resulting lower prices reduce profits and producer surplus\, but increase consumer surplus and improve overall market efficiency.

DESCRIPTION:  \n \nADVOCATE GENERAL KOKOTT SAYS THE COURT OF JUSTICE SHOULD DISMISS GOOGLE’S APPEAL AND UPHOLD THE JUDGMENT OF THE GENERAL COURT \nThomas Vinje\, Professor II on the Faculty of Law at UiB and BECCLE\, and Senior Counsel / Chair Emeritus of Clifford Chance’s Global Antitrust Group\, visits BECCLE to discuss the key issues addressed by Advocate General Kokott in her opinion in case C-738/22 P\, Google Android. Dette utkastet er av mange blitt tolket som at EU-kommisjonen nå i mindre grad enn det som fremkommer i deres veiledningsnotat (‘guidance paper’) fra 2008 vil basere seg på en effekt-basert analyse når de skal avgjøre om det dominerende firma sin adferd er lovstridig. DESCRIPTION:Copyright: European Commission \nThe Draghi Report was submitted to the European Commission in September this year\, and it is an important input for the commission’s future work on competitiveness for Europe. Competition Policy is one of the issues discussed in the report. Although the report in general is in favor of an active and strict competition policy\, there are some proposals that would lead to a less strict competition policy. In particular\, the focus on firm scale – having large European firms to compete against foreign firms – will  de facto  lead to a less strict merger control. In the report the telecom sector is mentioned as one sector where scale in Europe is too limited\, and where it is a need for mergers and acquisitions between European firms. \n  \nIn this seminar\, Tommaso Valletti will comment on the proposals in the Draghi report\, generally about competition policy and state aid and in particular on merger control and the telecom sector. Valletti is professor at Imperial College London and adjunct professor at Norwegian School of Economics and BECCLE. SUMMARY:Google Shopping: The Final Word from the Court of Justice - Consequences for the Future of Article 102
DESCRIPTION:Copyright: Google LLC \nIn September 2024\, the European Court of Justice upheld the European Commission’s decision finding that Google had abused its dominant position in online search markets by favoring its own shopping service over those of its competitors in its general search results. The judgment addressed several of the most contested issues regarding the meaning of Article 102 and its enforcement. \nThomas Vinje will discuss the recent judgment and its meaning for the application of Article 102. Thomas represented the international trade association FairSearch in this case before the European Commission and the original complainant in the case (Foundem) before the European General Court and the Court of Justice. Does the Google Shopping judgment mean that a dominant company may never favour its own products or services?\nWhat are the limits of the Bronner doctrine on refusals to supply?\nWhat constitutes conduct by a dominant company that is not “on the merits” (which is one of the two basic criteria in determining whether a dominant company has infringed Article 102)? What factors may the Commission take into account in assessing whether conduct falls outside “competition on the merits”?\nWhat must the Commission do to establish a causal link between the practices at issue and the alleged effects thereof? In particular\, must the Commission in all cases undertake a counterfactual analysis to show how the market would have developed absent the conduct?\nIs there any general requirement in Article 102 cases for the Commission to prove that the relevant conduct would exclude as-efficient competitors?\nFinally\, what implications does the Google Shopping judgment have for the Draft Guidelines on the Application of Article 102 recently published by the European Commission? DESCRIPTION:De siste årene har det internasjonalt blitt mer fokus på konkurransepolitiske inngrep i arbeidsmarkedet. Både i Europa og USA har det blitt grepet inn mot tilfeller der arbeidsgivere blir enige om å ikke konkurrere om arbeidskraften (‘no poaching’ avtaler). De nye retningslinjene for fusjonskontroll i USA er tydelige på at det kan gripes inn mot fusjoner og oppkjøp som er skadelige for arbeidstakerne. Spørsmålet vi stiller på dette seminaret er hvorvidt en i Europa\, og ikke minst i Norge\, bør og kan fokusere mer på arbeidsmarkedet i fusjonskontrollen. Er det særskilte forhold i Norge som gjør det mindre aktuelt med et slikt fokus her? Hvordan skal en evt avveie hensyn til sluttbrukerne og hensynet til arbeidstakerne? Er det mulig innenfor dagens regelverk å gripe inn på tilsvarende måte som det som skisseres i de amerikanske retningslinjene for fusjonskontroll? \nProfessor Lars Sørgard fra Norges Handelshøyskole og BECCLE og professor Ronny Gjendemsjø fra Universitetet i Bergen og BECCLE vil innlede med å belyse problemstillingen fra henholdsvis et økonomisk og juridisk perspektiv. SUMMARY:Cultural exception? The impact of fixed book price regulation on prices and variety
DESCRIPTION:On November 21 Tommaso Valletti\, professor at Imperial College London and professor II at NHH/BECCLE will hold a seminar about regulation in the book market. A few years ago Italy allowed for fixed book prices\, where publishers set prices in the book stores. In this seminar Tommaso Valletti will use a detailed data set to present evidence on how such a regulation affected book variety and prices. \nThis is a joint seminar with CBE (Center for Business Economics) at NHH. \nThe seminar will not be streamed. \nProfessor Valetti has co-authored an article on the subject. The abstract of the article is as following: \nFixed book price (FBP) agreements are a form of resale price maintenance commonly applied to books in various countries. FBP restricts retail price competition with the aim of promoting book production variety. Yet\, despite its popularity and application in many countries\, there is no empirical evidence on its effects. We offer systematic evidence on the impact of FBP on book variety and prices using a detailed new dataset from Italy that includes the universe of books published and bought\, before and after the introduction of FBP. Our results indicate that FBP raises prices without significantly affecting the number of new books published in the marketplace. However\, it also increases considerably the variety of books actually bought\, especially from independent bookstores.  We estimate a structural model of demand that accounts for both effects\, finding that consumers overall benefited from the regulation \nPlace: Department of Economics at NHH\, Room E209 \nTime: Tuesday November 21 at 12.15-13.30

Gjennom ECN+ direktivet har den offentlege desentraliserte handhevinga i det administrative sporet blitt styrka\, og gjennom regelverk slik som DMA har Kommisjonen utvida si sentraliserte handhevingsmyndigheit av digitale teneste. I Noreg er ingen av desse regelverka implementerte endå\, men vi ser dei same tendensane gjennom debattane som går i desse dagar om blant anna handhevingsverktøy som marknadsetterforsking og personstraff. \nMedan marknadsetterforskingsverktøyet gir Konkurransetilsynet vid myndigheit til å gripe inn i marknader utan at konkurranseforboda er brotne og sånn sett søkjer å rettleie marknader før konkurransesituasjonen forverrast\, utgjer personstraff ein meir klassisk sanksjon som kjem inn etter at eit av forboda er brotne både for å straffe dei som har gjort urett og avskrekke andre frå å gjere same økonomiske kriminalitet. SUMMARY:The Digital Markets Act - what now?
DESCRIPTION:  \nFriday September 29th there will be a BECCLE seminar with Thomas Kramler\, head of the unit Digital Platforms III in the Competition Directorate General of the European Commission. Thomas will talk about the genesis of the DMA and its main features\, with emphasis on the interplay with competition law. His unit is responsible for the enforcement of the Digital Markets Act and Articles 101 and 102 TFEU in relation to digital platforms. At the seminar Thomas will take us through the decisions directed at the platform services having been designated gatekeepers\, and the upcoming compliance regime. \n  \n  \nThomas Kramler \nHead of the unit Digital Platforms III in the Competition Directorate General of the European Commission. The unit is responsible for the enforcement of the Digital Markets Act and Articles 101 and 102 TFEU in relation to digital platforms. Before that\, he was Head of the Digital Single Market Task Force responsible for the ecommerce sector inquiry. He holds a law degree and a PhD from the University of Vienna\, Austria\, and has graduated with a Master’s degree in European Community Law from the College of Europe (Bruges). \nPreviously Mr Kramler was deputy head of the unit responsible for antitrust cases in the information industries\, internet and consumer electronics sectors. DESCRIPTION:There is a debate in both the US and Europe about the principles of merger control. One view is that we should move towards having more presumptions in merger reviews\, and then move partly away from a pure effects-based approach. Tommasso Valletti is proposing such a shift in the procedures for merger control. He is professor in economics at Imperial College in London\, adjunct professor at Norwegian School of Economics and BECCLE\, and a former chief economist at DG COMP. \nIn this seminar he will present his view\, where he argues that there should be more structural presumptions in merger control. SUMMARY:Mergers and Demand-Enhancing Innovation
DESCRIPTION:  \nCANCELLED! (Due to cancelled flight) \nYassine Lefouili from the Toulouse School of Economics will give a seminar on Mergers and Demand-Enhancing Innovation. This is a joint seminar of the Centre for Business Economics (NHH) and BECCLE.  \n  \n  \n  \nAbstract \nWe study the impact of horizontal mergers on merging firms’ incentives to invest in demand-enhancing innovation. In our baseline model\, we identify four effects of a symmetric merger on these incentives: the innovation diversion effect\, the margin expansion effect\, the demand expansion effect\, and the per unit return to innovation effect. We offer sufficient conditions for a merger to reduce or raise merging firms’ incentives to innovate in the absence of spillovers and efficiency gains in R&D\, and find that a comparison between the innovation diversion and price diversion ratios is informative about the impact of a merger on innovation. \n  \nThe seminar will take place on the 16th of May from 12.15 to 13.30 pm at the Department of Economics at NHH\, room E209/210.

Ronnie is also honorary chairman of the board of directors of the Belgian transmission system operator. \n  \n  \n \nVaido Poldoja is a Senior Legal Officer at the Competition and State aid directorate of the EFTA Surveillance Authority (ESA). Among other tasks\, Vaido handles adopting ESA’s new Guidelines on State aid for Climate\, Environmental protection and Energy. Prior to joining ESA\, Vaido worked in various state aid units at the European Commission (DG Competition) and spent several years in private practice at a pan-Baltic law firm in Estonia. \n  \n  \n \nLeigh Hancher is Professor of European Law at the University of Tilburg. She is a part-time Professor at the Florence School of Regulation within the European University Institute and the Director of the FSR Energy Union Law Area. Her research interests include energy market regulation\, EU state aids and energy market governance. She has also been a Professor at the Erasmus University in Rotterdam\, a Visiting Professor at the University of Calgary\, Canada\, Head of Legal at the Energy Charter Secretariat in Brussels and a member of the Dutch Academic Advisory Council (WRR). \n

DESCRIPTION:I november 2020 forbød Konkurransetilsynet Schibsteds oppkjøp av Nettbil\, basert på at det ville medføre en betydelig begrensning i effektiv konkurranse i markedet. Konkurranseklagenemnda ga i mai 2021 Konkurransetilsynet medhold. Partene anket til Gulating lagmannsrett\, og de fikk i mars 2022 medhold. Staten anket saken inn for Høyesterett\, og Høyesterett forkastet i februar 2023 anken. Det var hovedsakelig basert på at Finn og Nettbils produkter ikke konkurrerte med hverandre. \nI dette seminaret ønsker vi å diskutere Finn/Nettbil saken\, og hvilke implikasjoner Høyesteretts dom får for fremtidige saker om foretakssammenslutninger. DESCRIPTION:Market investigation tool in Norway?\n \nIn recent years\, there has been an ongoing debate about new competition law tools that could complement existing competition law tools. In the EU both the Digital Markets Act (DMA) and the Digital Services Act (DSA) have been heavily debated. At the same time there are countries such as Iceland and United Kingdom that already for many years have had a competition tool called “market investigation”. This is a tool that makes it possible to investigate a particular industry\, and propose measures to correct any adverse effect on competition even if there is no established violation of the competition rules. Earlier this year\, the Norwegian Ministry for Industry and Fisheries proposed that the Norwegian Competition Authority should be given the authority to perform market investigations\, similar to the CMA’s model. So far such a new competition tool has not been implemented. The seminar invites to a discussion on the pros and cons of such a new competition tool. To do this\, we have three distinguished speakers: \n\nSenior Director Daniel Gordon\, Competition & Markets Authority\, United Kingdom\nSenior Advisor Hans-Petter Håvås Hanson\, Norwegian Competition Authority\nPartner Kristin Hjelmaas Valla\, Kvale law firm\n\nDaniel Gordon will explain the market investigation tool that has been used in the UK for many years\, while Hans-Petter Håvås Hanson will discuss the main reasons for introducing such a competition tool in Norway. DESCRIPTION:Tomaso Duso will present his empirical study of EU merger control\, done jointly with Paula Affeldt\, Klaus Gugler and Joanna Piechucka. They analyze more than 1000 mergers scrutinized by the European Commission between 1980 and 2019.  One finding from their study is that they are concerned about the Commission’s merger enforcement being too lax. \nTime: May 24 2022\, 12.15-13.30 \nVenue: Room E209/210\, Norwegian School of Economics \nThis is a joint seminar with Center for Business Economics (CBE) at NHH \n  \nDownload paper here. \n  \nAbstract: Worldwide\, the overwhelming majority of large horizontal mergers are cleared by antitrust authorities unconditionally. The presumption seems to be that efficiencies from these mergers are sizeable. We calculate the compensating efficiencies that would prevent a merger from harming consumers for 1\,014 mergers affecting 12\,325 antitrust markets scrutinized by the European Commission between 1990 and 2018. Compensating efficiencies seem too large to be achievable for many mergers. Barriers to entry and the number of firms active in the market are the most important factors determining their size. We highlight concerns about the Commission’s merger enforcement being too lax.

DESCRIPTION:Professor Maarten Pieter Schinkel \nA more sustainable society is needed to slow down and ultimately reverse the rapid climate change. For firms to become more sustainable\, they are often encouraged to join forces for example by entering sustainability agreements. SUMMARY:The role of privacy in competition law
DESCRIPTION:Bergen Center for Competition Law and Economics (BECCLE)\, the Research group for EU/EEA Commercial law and the Research group for Information and Innovation law\, are pleased to announce a guest lecture by Ms. Arletta Gorecka\, PhD Candidate in Law at the University of Strathclyde\, Glasgow. In the lecture\, Ms. Gorecka will elaborate on the role of privacy in competition law by presenting two recent cases. The lecture will take place 23. September via Zoom (the link is published below). \n“The relationship between competition law and privacy is still seen as problematic with academics and professionals trying to adequately assess the impact of privacy on the competition law sphere.” Indeed\, it is not difficult to agree with Ms. Gorecka\, whose research is dedicated to the increasingly more interesting interplay between competition law and personal data protection.In June\, Ms Gorecka published a chapter “Is “Privacy” a means to protect the competition or advance objectives of innovation and consumer welfare?” in Maria Tzanou (Ed.)\, Personal Data Protection and Legal Developments in the European Union Hershey\, PA\, IGI Global\, 2020. \nMs. Gorecka will elaborate on the topic by examining two recent cases. The first concerns Facebook\, an online social media and social networking service that does not require any further introduction. On 23 June 2020\, the German Federal Court of Justice (Bundesgerichtshof) provisionally confirmed the allegation of Facebook abusing dominant position as a result of Facebook’s terms of service that allow for the processing and use of user data\, which are collected online outside the Facebook platform. The German Competition Authority (Bundeskartellamt) prohibited Facebook from processing such data without additional consent given by private users. On 23 June the antitrust division of the Federal Court of Justice decided that the Bundeskartellamt’s prohibition can be enforced. \nThe second case concerns the European Commission’s in-depth investigation into the proposed acquisition of Fitbit by Google. Fitbit is an American company active in the development\, manufacturing and distribution of wearable devices (both smartwatches and fitness trackers) and connected scales in the health and wellness sector\, as well as in the supply of related software and services. As provided in the press release\, the Commission is concerned that the proposed transaction would further entrench Google’s market position in the online advertising markets by increasing the already vast amount of data that Google could use for personalisation of the ads it serves and displays. As Executive Vice-President Margrethe Vestager\, responsible for competition policy\, clarified: “The use of wearable devices by European consumers is expected to grow significantly in the coming years. This will go hand in hand with an exponential growth of data generated through these devices. This data provides key insights about the life and the health situation of the users of these devices. Our investigation aims to ensure that control by Google over data collected through wearable devices as a result of the transaction does not distort competition.” \nThe lecture will take place via Zoom. The paper studies industries in which retailers face asymmetric input prices from their upstream suppliers\, such as the Norwegian grocery market. \nPlease note that the venue is the Department of Economics\, University of Bergen (Fosswinckelsgate 14)\, Seminar room 327 (3rd floor). \nAbstract: “In this paper\, we analyse the effects of input price discrimination by an upstream monopolist selling to firms with various degrees of efficiency. When downstream markets are independent\, we first study whether the upstream monopolist has an incentive to reduce or to increase the relative cost difference amongst downstream firms. Then\, we examine the impact of input price discrimination on output and welfare. A key determinant of the effects of input price discrimination on prices\, output\, and welfare is the sum of demand curvature and pass-through elasticity. We apply our findings to the set of demand forms with constant pass-through rates\, as well as other demand forms. We also discuss the cases of demand asymmetries across markets and price competition downstream”. \n  \n

DESCRIPTION:John Unwing/Unsplash. \n  \n17. Oktober inviterer BECCLE til et seminar om hvorfor og hvordan man kan stimulere til lokal deltakelse i offentlige anskaffelsesprosesser. Seminaret finner sted fra 12:15-14:00 i Auditoriet i Jusbygg II på det juridiske fakultet ved Universitetet i Bergen. Forsker Malin Arve (NHH) vil snakke om hvorfor dette er økonomisk lønnsomt og Ragnhild Kristina Ølstad (Inventura) vil presentere det juridiske handlingsrommet og hvordan man kan stimulere til økt konkurranse og deltakelse. Til sist vil representanter fra Sykehusinnkjøp presentere hvordan de legger til rette for bred deltakelse både fra lokale og nasjonale bedrifter i sine utlysninger.  \nEt argument for å sentralisere innkjøp er stordriftsfordeler\, men faren er at små og lokale bedrifter ikke får mulighet til å delta i konkurransen. \nI fjor fikk Kjetil Smørås og hotellkjeden De Bergenske erfare dette da de ikke fikk delta i konkurransen om en hotellavtale med Helse Bergen. Smørås fikk støtte fra både politikere og Konkurransetilsynet. Dette fikk Sykehusinnkjøp (som var ansvarlig for konkurransen til Helse Bergen) til å se nærmere på hvordan de kan innrette anskaffelser slik at de kan ivareta små og mellomstore kjeder og enkeltstående hoteller. \nSenest i august 2019 ble Kjetil Smørås og De Bergenske utsatt for det samme igjen. Denne gangen i en anbudskonkurranse om hotelltjenester utlyst av Universitets- og høgskolerådet. \nDette seminaret tar for seg hvorfor det er økonomisk lønnsomt å inkludere små og mellomstore bedrifter i anskaffelsesprosessen\, hva loven sier og det juridiske handlingsrommet\, samt vil Sykehusinnkjøp bli brukt som en konkret case for hvordan dette kan gjøres i praksis.
