\n  \nTid: 16. april 2026 kl 14:00-15:30 \nSted: Juridisk Fakultet\, Universitetet i Bergen\, Auditorium 4 \nTema: Økonomiske eksperter i erstatningssaker \nInnledere: Frode Steen og Lars Sørgard \nThe seminar will be streamed and a link to Zoom will become available here before the seminar.

SUMMARY:Private Enforcement of Competition Law
DESCRIPTION:Private enforcement of competition law\, particularly through damages actions\, has grown significantly across Europe over the past decade. Yet striking the right balance between effective public enforcement and safeguarding the rights of parties harmed by anticompetitive conduct remains a challenge. Despite important legislative initiatives\, such as the Damages Directive from 2014\, access to justice through national courts varies considerably across jurisdictions. \nA key reason is the lack of full harmonization. Procedural autonomy continues to allow divergent national approaches to issues such as litigation funding\, disclosure rules\, and the balance between protecting leniency applicants and enabling effective claimant actions. \n In this seminar\, BECCLE is proud to bring together leading practitioners and scholars in the field of competition law. The programme will provide insight into the current regulatory framework\, covering EU\, EEA\, and Norwegian perspectives\, and examine a broad range of issues related to private enforcement of competition law. Drawing on practical experience\, speakers will discuss how to build a claimant’s case and share concrete case examples\, including insights from the UK system and the latest developments from Brussels. \n The seminar will be chaired by Thomas Vinje\, Senior Counsel at Clifford Chance and external affiliate at the University of Bergen. He will be joined by Nivi Balaji\, Counsel at Clifford Chance; Sean Ennis\, Professor at Norwich Business School\, University of East Anglia; and BECCLE’s own Associate Professor Ingrid Barlund. \n \nTitle: Private Enforcement of Competition Law\nDate and time: Thursday March 5\, 10.00 – 11.30\nLocation: Auditorium 4\, Faculty of Law\, University of Bergen \nThe seminar will be streamed\, Zoom link

SUMMARY:Pricing in petrol markets
DESCRIPTION:BECCLE would like to welcome you to this joint BECCLE and NHH (Micro research group) seminar on the pricing in petrol markets\, which will take place at NHH on November 18. \nFor a long time there has been debate in many countries about the pricing in petrol markets. One question that has been frequently discussed\, is whether the petrol price cycles that have been observed in many countries\, is a sign of competition or collusion. At this seminar\, Yiming Liu will discuss pricing behavior in petrol markets\, with a particular focus on how behavioral models can help us to understand the toughness of price competition in these markets. \nYiming Liu\, post doc at the Humboldt University of Berlin. \nTitle: Pricing in petrol markets\nSpeaker: Yiming Liu\, post doc at the University of Humboldt\nDate and time: November 18\, 12.15-13.30\nLocation: Department of Economics at NHH\, Room E209/E210 \nAbstract of paper:\nWe show how cognitive constraints systematically shape pricing behavior in a firm with over 20\,000 gas stations. Consistent with insights from behavioral models of bounded rationality\, station managers with lower cognitive skills have biased mental models. These underestimate competitor sophistication and competitor retaliation for price cuts\, and thus place more confidence in the efficacy and profitability of low prices. In the field\, managers with lower cognitive skills set lower prices\, and engage in more price wars. The resulting lower prices reduce profits and producer surplus\, but increase consumer surplus and improve overall market efficiency.

SUMMARY:Google Android – Approaching the end of the saga?
DESCRIPTION:  \n \nADVOCATE GENERAL KOKOTT SAYS THE COURT OF JUSTICE SHOULD DISMISS GOOGLE’S APPEAL AND UPHOLD THE JUDGMENT OF THE GENERAL COURT \nThomas Vinje\, Professor II on the Faculty of Law at UiB and BECCLE\, and Senior Counsel / Chair Emeritus of Clifford Chance’s Global Antitrust Group\, visits BECCLE to discuss the key issues addressed by Advocate General Kokott in her opinion in case C-738/22 P\, Google Android. Thomas will discuss\, in particular\, AG Kokott’s positions on the two issues raised in Google’s Android appeal that are generally regarded as having great significance for the future of Article 102 jurisprudence\, namely: \n\nWas the Commission required to undertake a (but-for) counterfactual analysis proving how Google might have behaved had it not adopted the contested abusive conduct\nWere the Commission (and the General Court) required to extend their examination beyond the capacity of Google’s tying conduct to restrict competition and to assess whether that conduct was capable specifically of foreclosing competitors as efficient as Google?\n\nThomas filed the complaint on behalf of FairSearch against Google that led the European Commission to pursue its case against Google on its Android-related conduct.  He pursued the complaint throughout the administrative proceedings leading to the Commission’s decision against Google and represented FairSearch in support of the European Commission in Google’s appeal before the General Court and Court of Justice of the European Union. \nLocation: Faculty of Law\, University of Bergen\, Auditorium 3\nWhen: Thursday 11. september\,  12.15-13.30 \nVinje’s presentation \nThe seminar will be streamed and a zoom link will come here: https://uib.zoom.us/j/64389983842?pwd=xWVOTebdnBMnWJvFs8mYPEm8wyWfy4.1

SUMMARY:Data Protection\, Competition and Consumer Law Interplay in a Data-Driven Economy: Evidence from Ukraine and Norway
DESCRIPTION:This seminar seeks to foster critical discussion among scholars\, practitioners and regulatory experts on the legal and institutional frameworks governing digital markets\, with the aim of gaining insights from Norway. Speakers from Ukraine will address the challenges of war for the data-driven economy and the impact of data protection and competition law. This will be followed by a round of reflections from a Norwegian perspective. \nPROGRAMME\nWar and the Data-Driven Economy: Challenges and Solutions \nDr. Liudmyla Petrenko \n\nProfessor\, Department of Business Economics and Entrepreneurship\, Kyiv National Economic University after Vadym Hetman (KNEU); Visiting scholar at the Max Planck Institute for Innovation and Competition (Munich\, Germany)\, 2022-2025\n\n \nThe presentation examines how Ukrainian digital platforms have strategically leveraged user data\, regulatory frameworks\, and innovative governance models to drive business growth and resilience in wartime conditions. Drawing on recent trends: The e-commerce market rose to nearly $4 billion in 2024\, marking a ~30% YoY increase\, driven by digital payments\, mobile commerce\, and omnichannel approaches. The IT and fintech sector\, contributing almost 5% to GDP\, reached $8 billion in revenue in 2023\, underscoring the sector’s economic significance. The analysis emphasizes how digital technologies facilitated economic continuity\, enabling remote work\, sustaining export revenues\, and supporting domestic consumption through innovative online platforms. Additionally\, it addresses significant challenges\, such as infrastructure damage\, human capital loss\, and cybersecurity threats\, detailing Ukraine’s adaptive strategies including cloud migration\, international collaboration\, and enhanced digital governance. The study concludes by reflecting on how the crisis has accelerated digital transformation\, creating lasting structural changes and global integration opportunities vital for Ukraine’s post-war economic recovery. \nData Protection and Competition Law: Cross-Regulatory Solutions for Ukraine \nDr. Nataliia Mazaraki \n\nChair of the International\, civil and commercial law department\, State University of Trade and Economics\, Visiting scholar at the Max Planck Institute for Innovation and Competition (Munich\, Germany)\, 2022-2025\n\n \nThe analysis identifies opportunities for cross-regulatory cooperation between Ukraine’s competition authority and data protection agencies\, suggesting integrated regulatory approaches to effectively manage digital market power and safeguard personal data—essential components of Ukraine’s digital transformation and European integration. The research highlights cases and key regulatory trends in Ukrainian digital markets and data governance: (1) BlaBlaCar antitrust case (2025) – the Antimonopoly Committee of Ukraine (AMCU) fined the local operator approximately ₴424\,000 for failing to provide requested competition information\, marking the first enforcement action in the online P2P mobility sector and signaling broader scrutiny of digital platforms; (2) Kyiv Digital vs. MIA platform bias (2025) – AMCU issued formal recommendations to prevent state-led favoritism toward the MIA’s driving simulator app over private competitors\, reinforcing the application of competition rules to government-backed platforms. Legal and market trends illustrate a dynamic shift\, as Ukraine’s legal system actively shapes the governance of digital platforms by embedding competition and data protection principles into its digital economy framework: (а) Expanding AMCU enforcement – In 2024\, the AMCU handled 312 information-related cases in digital markets\, signaling a shift from traditional cartel oversight toward platform-centric regulation; (b) GDPR-aligned reforms – Draft Law № 8153 (2022) introduces new rights\, breach notification requirements\, and expanded definitions\, deepening alignment with EU standards; (с) Digital public law innovation – Ukraine enacted laws on electronic documents and e-justice\, supported by the Diia platform\, enabling paperless courts and digital state services even during wartime; (d) Platform strategy meets legal control – Both state and private platforms are increasingly integrating AI-driven operations\, privacy-by-design principles\, and anti-bias compliance measures in response to AMCU enforcement and GDPR-style regulations. \nShort comment from the NorwegianCompetition Authority (Konkurransetilsynet) \nRound table discussion \n\nModerated by Liliia Oprysk\n\nDate: 21 August 2025 \nTime: 10.00-12.00 \nVenue: Library at the Faculty of Law\, University of Bergen \nRegistration HERE \nThe seminar will not be streamed

\nTema: Misbruk av dominans og ytelsesbasert konkurranse\nInnledere: Professor Ronny Gjendemsjø\, Universitetet i Bergen og Erling J. SUMMARY:The Draghi Report and the future of Competition Policy and State Aid in Europe
DESCRIPTION:Copyright: European Commission \nThe Draghi Report was submitted to the European Commission in September this year\, and it is an important input for the commission’s future work on competitiveness for Europe. Competition Policy is one of the issues discussed in the report. Although the report in general is in favor of an active and strict competition policy\, there are some proposals that would lead to a less strict competition policy. In particular\, the focus on firm scale – having large European firms to compete against foreign firms – will  de facto  lead to a less strict merger control. In the report the telecom sector is mentioned as one sector where scale in Europe is too limited\, and where it is a need for mergers and acquisitions between European firms. \n  \nIn this seminar\, Tommaso Valletti will comment on the proposals in the Draghi report\, generally about competition policy and state aid and in particular on merger control and the telecom sector. Valletti is professor at Imperial College London and adjunct professor at Norwegian School of Economics and BECCLE. He has for three years served as the chief economist in European Commission (Directorate General for Competition).  \nThere will be time for comments and questions from the audience. \nDate and Time: Thursday\, December 5\, from 12:00 to 13:30\nLocation: The Library\, 5th Floor\, Faculty of Law\, University of Bergen \nWe look forward to your participation. For those unable to attend in person\, the seminar will be streamed live via Zoom. Please follow this link to join us. \n  \n  \n

SUMMARY:Google Shopping: The Final Word from the Court of Justice - Consequences for the Future of Article 102
DESCRIPTION:Copyright: Google LLC \nIn September 2024\, the European Court of Justice upheld the European Commission’s decision finding that Google had abused its dominant position in online search markets by favoring its own shopping service over those of its competitors in its general search results. The judgment addressed several of the most contested issues regarding the meaning of Article 102 and its enforcement. \nThomas Vinje will discuss the recent judgment and its meaning for the application of Article 102. Thomas represented the international trade association FairSearch in this case before the European Commission and the original complainant in the case (Foundem) before the European General Court and the Court of Justice. For a comprehensive overview of Thomas Vinje’s biography\, please follow the link. \n  \n  \nOur seminar will focus on the key issues resolved in the judgment\, including the following: \n\nWhen does a dominant company’s favouring of its own products or services constitute an abuse under Article 102? Does the Google Shopping judgment mean that a dominant company may never favour its own products or services?\nWhat are the limits of the Bronner doctrine on refusals to supply?\nWhat constitutes conduct by a dominant company that is not “on the merits” (which is one of the two basic criteria in determining whether a dominant company has infringed Article 102)? What factors may the Commission take into account in assessing whether conduct falls outside “competition on the merits”?\nWhat must the Commission do to establish a causal link between the practices at issue and the alleged effects thereof? In particular\, must the Commission in all cases undertake a counterfactual analysis to show how the market would have developed absent the conduct?\nIs there any general requirement in Article 102 cases for the Commission to prove that the relevant conduct would exclude as-efficient competitors?\nFinally\, what implications does the Google Shopping judgment have for the Draft Guidelines on the Application of Article 102 recently published by the European Commission? More generally\, we expect to discuss whether the Commission has adopted a valid approach to Article 102 case law in its draft Guidelines\n\nProfessor Ronny Gjendemsjø will be chairing the event. \nTime and place:\nUniversity of Bergen\, Faculty of Law\nTuesday November 12 10:15-12:00\, Auditorium 3 \n\nTo watch the recording of this lecture\, please follow the link.

SUMMARY:Seminar om arbeidsmarkedet og fusjonskontrollen

SUMMARY:Cartel Policy in Nordic Countries
DESCRIPTION:Enforcement of laws prohibiting cartels is a fundamental part of antitrust policy in most countries. This has also been\nthe case in the Nordic countries for several decades. Although the Nordic countries’ antitrust enforcement is\nharmonized with EU competition law\, the enforcement systems have until recently varied quite a lot from country to\ncountry in the Nordic region. \nIn this seminar we will discuss the design of better cartel policies and\, in particular\, how various elements\ncomplement each other to lead to more effective policies. Beginning with a general discussion of cartel policy design\,\nwe will then explain and discuss the legal enforcement systems in the four largest Nordic countries of Norway\,\nDenmark\, Finland\, and Sweden\, emphasizing similarities\, but even more so how they differ. Next\, the legal cartels\nthat existed before 2000 will be contrasted with the illegal cartels that have been detected by competition\nauthorities during the last two decades. We will also review and discuss recent changes in Swedish cartel policy.\nFinally\, recent challenges for cartel enforcement will be discussed with a focus on the rise in the role of algorithms. \nDETAILED PROGRAM \nSpeakers presentations: \nJoseph Harrington\, Professor of Business Economics and Public Policy at The Wharton School\, University of\nPennsylvania\, Design of optimal cartel policy \nIngrid M. SUMMARY:Det fremtidige norske kraftmarkedet
DESCRIPTION:Markedet for elektrisk kraft er i endring. \nTid: Tirsdag 30. januar 2024 kl 13-15.30 \nSted: Juridisk Fakultet\, Universitetet i Bergen\, Auditorium 3 (M. SUMMARY:Cultural exception? The impact of fixed book price regulation on prices and variety
DESCRIPTION:On November 21 Tommaso Valletti\, professor at Imperial College London and professor II at NHH/BECCLE will hold a seminar about regulation in the book market. A few years ago Italy allowed for fixed book prices\, where publishers set prices in the book stores. In this seminar Tommaso Valletti will use a detailed data set to present evidence on how such a regulation affected book variety and prices. \nThis is a joint seminar with CBE (Center for Business Economics) at NHH. \nThe seminar will not be streamed. \nProfessor Valetti has co-authored an article on the subject. The abstract of the article is as following: \nFixed book price (FBP) agreements are a form of resale price maintenance commonly applied to books in various countries. FBP restricts retail price competition with the aim of promoting book production variety. Yet\, despite its popularity and application in many countries\, there is no empirical evidence on its effects. We offer systematic evidence on the impact of FBP on book variety and prices using a detailed new dataset from Italy that includes the universe of books published and bought\, before and after the introduction of FBP. Our results indicate that FBP raises prices without significantly affecting the number of new books published in the marketplace. However\, it also increases considerably the variety of books actually bought\, especially from independent bookstores.  We estimate a structural model of demand that accounts for both effects\, finding that consumers overall benefited from the regulation \nPlace: Department of Economics at NHH\, Room E209 \nTime: Tuesday November 21 at 12.15-13.30

SUMMARY:Mot ein sterkare offentlegrettsleg administrativ handheving av konkurransereglane
SUMMARY:Norwegians oppkjøp av Widerøe
SUMMARY:Structural presumptions in merger control?
DESCRIPTION:There is a debate in both the US and Europe about the principles of merger control. One view is that we should move towards having more presumptions in merger reviews\, and then move partly away from a pure effects-based approach. Tommasso Valletti is proposing such a shift in the procedures for merger control. He is professor in economics at Imperial College in London\, adjunct professor at Norwegian School of Economics and BECCLE\, and a former chief economist at DG COMP. \nIn this seminar he will present his view\, where he argues that there should be more structural presumptions in merger control. Your can read about his view HERE. Three Norwegian experts on competition policy will comment on his talk: \n\nDeputy Director Marita Skjæveland\, Norwegian Competition Authority\nPartner Beret Sundet\, BAHR law firm\nPartner Jostein Skaar\, Oslo Economics\n\n  \nThe seminar will be held: \n\nAuditorium 4\, Faculty of Law at University of Bergen\nWednesday June 14 at 10:00-11:45\n\nYou are welcome to attend the seminar physically. Note that it will also be streamed. \nThe seminar can be seen in replay here. \nThe slides can be seen here: Marita Skjæveland\, Jostein Skaar\, Tommaso Valletti

SUMMARY:Mergers and Demand-Enhancing Innovation
DESCRIPTION:  \nCANCELLED! (Due to cancelled flight) \nYassine Lefouili from the Toulouse School of Economics will give a seminar on Mergers and Demand-Enhancing Innovation. This is a joint seminar of the Centre for Business Economics (NHH) and BECCLE.  \n  \n  \n  \nAbstract \nWe study the impact of horizontal mergers on merging firms’ incentives to invest in demand-enhancing innovation. In our baseline model\, we identify four effects of a symmetric merger on these incentives: the innovation diversion effect\, the margin expansion effect\, the demand expansion effect\, and the per unit return to innovation effect. We offer sufficient conditions for a merger to reduce or raise merging firms’ incentives to innovate in the absence of spillovers and efficiency gains in R&D\, and find that a comparison between the innovation diversion and price diversion ratios is informative about the impact of a merger on innovation. \n  \nThe seminar will take place on the 16th of May from 12.15 to 13.30 pm at the Department of Economics at NHH\, room E209/210.

SUMMARY:Finn/Nettbil saken: Lærdommer fra Høyesteretts dom
Konkurranseklagenemnda ga i mai 2021 Konkurransetilsynet medhold. Opptaket kan sees her. Lysbildene fra innleggene er vedlagt nedenfor. \nErling Hjelmeng \, Frode Steen

SUMMARY:Market investigation tool in Norway?
DESCRIPTION:Market investigation tool in Norway?\n \nIn recent years\, there has been an ongoing debate about new competition law tools that could complement existing competition law tools. In the EU both the Digital Markets Act (DMA) and the Digital Services Act (DSA) have been heavily debated. At the same time there are countries such as Iceland and United Kingdom that already for many years have had a competition tool called “market investigation”. This is a tool that makes it possible to investigate a particular industry\, and propose measures to correct any adverse effect on competition even if there is no established violation of the competition rules. Earlier this year\, the Norwegian Ministry for Industry and Fisheries proposed that the Norwegian Competition Authority should be given the authority to perform market investigations\, similar to the CMA’s model. So far such a new competition tool has not been implemented. The seminar invites to a discussion on the pros and cons of such a new competition tool. To do this\, we have three distinguished speakers: \n\nSenior Director Daniel Gordon\, Competition & Markets Authority\, United Kingdom\nSenior Advisor Hans-Petter Håvås Hanson\, Norwegian Competition Authority\nPartner Kristin Hjelmaas Valla\, Kvale law firm\n\nDaniel Gordon will explain the market investigation tool that has been used in the UK for many years\, while Hans-Petter Håvås Hanson will discuss the main reasons for introducing such a competition tool in Norway. Kristin Hjelmaas Valla will discuss such a competition tool seen from the business society’s perspective. \n\nWhen: Friday October 21\, 10-12 am\nWhere: Auditorium 3\, Faculty of Law\, University of Bergen\n\nThe seminar will also be streamed HERE.

SUMMARY:Er fusjonskontrollen for streng?
Innledere er \n\n\n\n\n\nPartner Heidi Jorkjend\, Advokatfirmaet  Thommessen\nProfessor Eirik Østerud\, Institutt for Privatrett\, Universitetet i Oslo\nProfessor Tommy S. Gabrielsen\, Institutt for økonomi\, Universitetet i Bergen\n\n\n\n\n\nSeminaret vil bli holdt \n\nAuditorium 4\, Juridisk Fakultet\, Universitetet i Bergen\nTorsdag 1. september kl 10-11.30\n\nSeminaret vil også bli strømmet.
