SUMMARY:Cartel Policy in Nordic Countries
DESCRIPTION:Enforcement of laws prohibiting cartels is a fundamental part of antitrust policy in most countries. This has also been\nthe case in the Nordic countries for several decades. Although the Nordic countries’ antitrust enforcement is\nharmonized with EU competition law\, the enforcement systems have until recently varied quite a lot from country to\ncountry in the Nordic region. \nIn this seminar we will discuss the design of better cartel policies and\, in particular\, how various elements\ncomplement each other to lead to more effective policies. Beginning with a general discussion of cartel policy design\,\nwe will then explain and discuss the legal enforcement systems in the four largest Nordic countries of Norway\,\nDenmark\, Finland\, and Sweden\, emphasizing similarities\, but even more so how they differ. Next\, the legal cartels\nthat existed before 2000 will be contrasted with the illegal cartels that have been detected by competition\nauthorities during the last two decades. SUMMARY:Seminar om arbeidsmarkedet og fusjonskontrollen
DESCRIPTION:De siste årene har det internasjonalt blitt mer fokus på konkurransepolitiske inngrep i arbeidsmarkedet. Både i Europa og USA har det blitt grepet inn mot tilfeller der arbeidsgivere blir enige om å ikke konkurrere om arbeidskraften (‘no poaching’ avtaler). De nye retningslinjene for fusjonskontroll i USA er tydelige på at det kan gripes inn mot fusjoner og oppkjøp som er skadelige for arbeidstakerne. Spørsmålet vi stiller på dette seminaret er hvorvidt en i Europa\, og ikke minst i Norge\, bør og kan fokusere mer på arbeidsmarkedet i fusjonskontrollen. Er det særskilte forhold i Norge som gjør det mindre aktuelt med et slikt fokus her? Hvordan skal en evt avveie hensyn til sluttbrukerne og hensynet til arbeidstakerne? Er det mulig innenfor dagens regelverk å gripe inn på tilsvarende måte som det som skisseres i de amerikanske retningslinjene for fusjonskontroll? \nProfessor Lars Sørgard fra Norges Handelshøyskole og BECCLE og professor Ronny Gjendemsjø fra Universitetet i Bergen og BECCLE vil innlede med å belyse problemstillingen fra henholdsvis et økonomisk og juridisk perspektiv. SUMMARY:Google Shopping: The Final Word from the Court of Justice - Consequences for the Future of Article 102
DESCRIPTION:Copyright: Google LLC \nIn September 2024\, the European Court of Justice upheld the European Commission’s decision finding that Google had abused its dominant position in online search markets by favoring its own shopping service over those of its competitors in its general search results. The judgment addressed several of the most contested issues regarding the meaning of Article 102 and its enforcement. \nThomas Vinje will discuss the recent judgment and its meaning for the application of Article 102. Thomas represented the international trade association FairSearch in this case before the European Commission and the original complainant in the case (Foundem) before the European General Court and the Court of Justice. For a comprehensive overview of Thomas Vinje’s biography\, please follow the link. \n  \n  \nOur seminar will focus on the key issues resolved in the judgment\, including the following: \n\nWhen does a dominant company’s favouring of its own products or services constitute an abuse under Article 102? Does the Google Shopping judgment mean that a dominant company may never favour its own products or services?\nWhat are the limits of the Bronner doctrine on refusals to supply?\nWhat constitutes conduct by a dominant company that is not “on the merits” (which is one of the two basic criteria in determining whether a dominant company has infringed Article 102)? What factors may the Commission take into account in assessing whether conduct falls outside “competition on the merits”?\nWhat must the Commission do to establish a causal link between the practices at issue and the alleged effects thereof? In particular\, must the Commission in all cases undertake a counterfactual analysis to show how the market would have developed absent the conduct?\nIs there any general requirement in Article 102 cases for the Commission to prove that the relevant conduct would exclude as-efficient competitors?\nFinally\, what implications does the Google Shopping judgment have for the Draft Guidelines on the Application of Article 102 recently published by the European Commission? SUMMARY:The Draghi Report and the future of Competition Policy and State Aid in Europe
DESCRIPTION:Copyright: European Commission \nThe Draghi Report was submitted to the European Commission in September this year\, and it is an important input for the commission’s future work on competitiveness for Europe. Competition Policy is one of the issues discussed in the report. Although the report in general is in favor of an active and strict competition policy\, there are some proposals that would lead to a less strict competition policy. In particular\, the focus on firm scale – having large European firms to compete against foreign firms – will  de facto  lead to a less strict merger control. In the report the telecom sector is mentioned as one sector where scale in Europe is too limited\, and where it is a need for mergers and acquisitions between European firms. \n  \nIn this seminar\, Tommaso Valletti will comment on the proposals in the Draghi report\, generally about competition policy and state aid and in particular on merger control and the telecom sector. Valletti is professor at Imperial College London and adjunct professor at Norwegian School of Economics and BECCLE. DESCRIPTION:Copyright: Eurac Research \nEU-kommisjonen har kommet med utkast til retningslinjer for misbruk av dominans (artikkel 102 i TFEU). Dette utkastet er av mange blitt tolket som at EU-kommisjonen nå i mindre grad enn det som fremkommer i deres veiledningsnotat (‘guidance paper’) fra 2008 vil basere seg på en effekt-basert analyse når de skal avgjøre om det dominerende firma sin adferd er lovstridig. Det er for eksempel satt opp to vilkår for at det skal være misbruk\, der ett av dem er at det ikke er ytelsesbasert konkurranse (competition on the merits). Drawing on recent trends: The e-commerce market rose to nearly $4 billion in 2024\, marking a ~30% YoY increase\, driven by digital payments\, mobile commerce\, and omnichannel approaches. The IT and fintech sector\, contributing almost 5% to GDP\, reached $8 billion in revenue in 2023\, underscoring the sector’s economic significance. The analysis emphasizes how digital technologies facilitated economic continuity\, enabling remote work\, sustaining export revenues\, and supporting domestic consumption through innovative online platforms. Additionally\, it addresses significant challenges\, such as infrastructure damage\, human capital loss\, and cybersecurity threats\, detailing Ukraine’s adaptive strategies including cloud migration\, international collaboration\, and enhanced digital governance. The study concludes by reflecting on how the crisis has accelerated digital transformation\, creating lasting structural changes and global integration opportunities vital for Ukraine’s post-war economic recovery. \nData Protection and Competition Law: Cross-Regulatory Solutions for Ukraine \nDr. Nataliia Mazaraki \n\nChair of the International\, civil and commercial law department\, State University of Trade and Economics\, Visiting scholar at the Max Planck Institute for Innovation and Competition (Munich\, Germany)\, 2022-2025\n\n \nThe analysis identifies opportunities for cross-regulatory cooperation between Ukraine’s competition authority and data protection agencies\, suggesting integrated regulatory approaches to effectively manage digital market power and safeguard personal data—essential components of Ukraine’s digital transformation and European integration. The research highlights cases and key regulatory trends in Ukrainian digital markets and data governance: (1) BlaBlaCar antitrust case (2025) – the Antimonopoly Committee of Ukraine (AMCU) fined the local operator approximately ₴424\,000 for failing to provide requested competition information\, marking the first enforcement action in the online P2P mobility sector and signaling broader scrutiny of digital platforms; (2) Kyiv Digital vs. MIA platform bias (2025) – AMCU issued formal recommendations to prevent state-led favoritism toward the MIA’s driving simulator app over private competitors\, reinforcing the application of competition rules to government-backed platforms. SUMMARY:Google Android – Approaching the end of the saga?
DESCRIPTION:  \n \nADVOCATE GENERAL KOKOTT SAYS THE COURT OF JUSTICE SHOULD DISMISS GOOGLE’S APPEAL AND UPHOLD THE JUDGMENT OF THE GENERAL COURT \nThomas Vinje\, Professor II on the Faculty of Law at UiB and BECCLE\, and Senior Counsel / Chair Emeritus of Clifford Chance’s Global Antitrust Group\, visits BECCLE to discuss the key issues addressed by Advocate General Kokott in her opinion in case C-738/22 P\, Google Android. One question that has been frequently discussed\, is whether the petrol price cycles that have been observed in many countries\, is a sign of competition or collusion. At this seminar\, Yiming Liu will discuss pricing behavior in petrol markets\, with a particular focus on how behavioral models can help us to understand the toughness of price competition in these markets. \nYiming Liu\, post doc at the Humboldt University of Berlin. \nTitle: Pricing in petrol markets\nSpeaker: Yiming Liu\, post doc at the University of Humboldt\nDate and time: November 18\, 12.15-13.30\nLocation: Department of Economics at NHH\, Room E209/E210 \nAbstract of paper:\nWe show how cognitive constraints systematically shape pricing behavior in a firm with over 20\,000 gas stations. Consistent with insights from behavioral models of bounded rationality\, station managers with lower cognitive skills have biased mental models. These underestimate competitor sophistication and competitor retaliation for price cuts\, and thus place more confidence in the efficacy and profitability of low prices. In the field\, managers with lower cognitive skills set lower prices\, and engage in more price wars. The resulting lower prices reduce profits and producer surplus\, but increase consumer surplus and improve overall market efficiency.

SUMMARY:Private Enforcement of Competition Law
DESCRIPTION:Private enforcement of competition law\, particularly through damages actions\, has grown significantly across Europe over the past decade. Yet striking the right balance between effective public enforcement and safeguarding the rights of parties harmed by anticompetitive conduct remains a challenge. Despite important legislative initiatives\, such as the Damages Directive from 2014\, access to justice through national courts varies considerably across jurisdictions. \nA key reason is the lack of full harmonization. Procedural autonomy continues to allow divergent national approaches to issues such as litigation funding\, disclosure rules\, and the balance between protecting leniency applicants and enabling effective claimant actions. \n In this seminar\, BECCLE is proud to bring together leading practitioners and scholars in the field of competition law. The programme will provide insight into the current regulatory framework\, covering EU\, EEA\, and Norwegian perspectives\, and examine a broad range of issues related to private enforcement of competition law. Drawing on practical experience\, speakers will discuss how to build a claimant’s case and share concrete case examples\, including insights from the UK system and the latest developments from Brussels. \n The seminar will be chaired by Thomas Vinje\, Senior Counsel at Clifford Chance and external affiliate at the University of Bergen. DESCRIPTION:BECCLE inviterer til seminar om økonomiske eksperters rolle i saker om erstatning for brudd på konkurransereglene den 16. april kl. 14:00 til 1530. Frode Steen (NHH og BECCLE) og Lars Sørgard (NHH og BECCLE) som begge har vært involvert i denne typen saker som ekspertvitner eller domstolsoppnevnte eksperter\, vil innlede om temaet. \nDet siste ti-året har vi sett en økt aktivitet hva angår erstatningssaker som følger av brudd på konkurranseloven. I slike saker er det krevende å beregne tapet for kundene som følge av bruddet på konkurransereglene. Anslag på tap som følge av konkurransebrudd\, i den grad det skal beregnes\, vil typisk bli gjort av økonomiske eksperter. I dette seminaret vil vi gjennom to eksempler belyse hvilken rolle økonomiske eksperter kan ha i erstatningssaker. Den ene saken omhandler ulovlig prissamarbeid i lastebilmarkedet i flere europeiske land\, en sak som har gått for retten i Norge. Den andre saken omhandler misbruk av dominans i markedet for elektrisk kraft i Danmark\, en sak som har gått for retten i Danmark. \n \n  \nFrode Steen er professor i samfunnsøkonomi ved Institutt for Samfunnsøkonomi på NHH\, og er nå leder for NHHs forskningsprogram FOOD på NHH som er finansiert av NorgesGruppen. Hans forskning og undervisning omhandler konkurranse\, og han har vært mye brukt som ekspertvitne i konkurransesaker. Han representerte Posten i erstatningssøksmålet mot det såkalte  lastebilkartellet som gikk for norske domstoler. \n \n  \nLars Sørgard er professor i samfunnsøkonomi ved NHH\, og hans forskning og undervisning omhandler konkurranse. Han var i perioden 2016-22 konkurransedirektør\, og var i perioden 2022-25 leder for BECCLE.
