SUMMARY:Seminar om arbeidsmarkedet og fusjonskontrollen

SUMMARY:Cartel Policy in Nordic Countries
DESCRIPTION:Enforcement of laws prohibiting cartels is a fundamental part of antitrust policy in most countries. This has also been\nthe case in the Nordic countries for several decades. Although the Nordic countries’ antitrust enforcement is\nharmonized with EU competition law\, the enforcement systems have until recently varied quite a lot from country to\ncountry in the Nordic region. \nIn this seminar we will discuss the design of better cartel policies and\, in particular\, how various elements\ncomplement each other to lead to more effective policies. Beginning with a general discussion of cartel policy design\,\nwe will then explain and discuss the legal enforcement systems in the four largest Nordic countries of Norway\,\nDenmark\, Finland\, and Sweden\, emphasizing similarities\, but even more so how they differ. Next\, the legal cartels\nthat existed before 2000 will be contrasted with the illegal cartels that have been detected by competition\nauthorities during the last two decades. We will also review and discuss recent changes in Swedish cartel policy.\nFinally\, recent challenges for cartel enforcement will be discussed with a focus on the rise in the role of algorithms. \nDETAILED PROGRAM \nSpeakers presentations: \nJoseph Harrington\, Professor of Business Economics and Public Policy at The Wharton School\, University of\nPennsylvania\, Design of optimal cartel policy \nIngrid M. H. Barlund\, Associate professor of Law\, University of Bergen\, Cartel enforcement within the Nordic countries – shared experiences and new insights \nFrode Steen\,Professor of Economics at Department of Economics\, Norwegian School of Economics\, Legal Cartels in Nordic Countries Before 2000 \nLars Sørgard\, Professor of Economics at Department of Economics\, Norwegian School of Economics\, Illegal cartels in Nordic countries after 2000 \nLars Henriksson\, Professor of Law\, Stockholm School of Economics\, Cartel enforcement in Sweden – recent experiences \n

SUMMARY:Det fremtidige norske kraftmarkedet
DESCRIPTION:Markedet for elektrisk kraft er i endring. \nTid: Tirsdag 30. januar 2024 kl 13-15.30 \nSted: Juridisk Fakultet\, Universitetet i Bergen\, Auditorium 3 (M. Lagabøtes gate 1) \nSeminaret er fysisk\, men vil i tillegg bli strømmet. LINK til stream \n

SUMMARY:Cultural exception? The impact of fixed book price regulation on prices and variety
DESCRIPTION:On November 21 Tommaso Valletti\, professor at Imperial College London and professor II at NHH/BECCLE will hold a seminar about regulation in the book market. A few years ago Italy allowed for fixed book prices\, where publishers set prices in the book stores. In this seminar Tommaso Valletti will use a detailed data set to present evidence on how such a regulation affected book variety and prices. \nThis is a joint seminar with CBE (Center for Business Economics) at NHH. \nThe seminar will not be streamed. \nProfessor Valetti has co-authored an article on the subject. The abstract of the article is as following: \nFixed book price (FBP) agreements are a form of resale price maintenance commonly applied to books in various countries. FBP restricts retail price competition with the aim of promoting book production variety. Yet\, despite its popularity and application in many countries\, there is no empirical evidence on its effects. We offer systematic evidence on the impact of FBP on book variety and prices using a detailed new dataset from Italy that includes the universe of books published and bought\, before and after the introduction of FBP. Our results indicate that FBP raises prices without significantly affecting the number of new books published in the marketplace. However\, it also increases considerably the variety of books actually bought\, especially from independent bookstores.  We estimate a structural model of demand that accounts for both effects\, finding that consumers overall benefited from the regulation \nPlace: Department of Economics at NHH\, Room E209 \nTime: Tuesday November 21 at 12.15-13.30

SUMMARY:Mot ein sterkare offentlegrettsleg administrativ handheving av konkurransereglane
SUMMARY:Norwegians oppkjøp av Widerøe
SUMMARY:Structural presumptions in merger control?
DESCRIPTION:There is a debate in both the US and Europe about the principles of merger control. One view is that we should move towards having more presumptions in merger reviews\, and then move partly away from a pure effects-based approach. Tommasso Valletti is proposing such a shift in the procedures for merger control. He is professor in economics at Imperial College in London\, adjunct professor at Norwegian School of Economics and BECCLE\, and a former chief economist at DG COMP. \nIn this seminar he will present his view\, where he argues that there should be more structural presumptions in merger control. Your can read about his view HERE. Three Norwegian experts on competition policy will comment on his talk: \n\nDeputy Director Marita Skjæveland\, Norwegian Competition Authority\nPartner Beret Sundet\, BAHR law firm\nPartner Jostein Skaar\, Oslo Economics\n\n  \nThe seminar will be held: \n\nAuditorium 4\, Faculty of Law at University of Bergen\nWednesday June 14 at 10:00-11:45\n\nYou are welcome to attend the seminar physically. Note that it will also be streamed. \nThe seminar can be seen in replay here. \nThe slides can be seen here: Marita Skjæveland\, Jostein Skaar\, Tommaso Valletti

SUMMARY:Mergers and Demand-Enhancing Innovation
DESCRIPTION:  \nCANCELLED! (Due to cancelled flight) \nYassine Lefouili from the Toulouse School of Economics will give a seminar on Mergers and Demand-Enhancing Innovation. This is a joint seminar of the Centre for Business Economics (NHH) and BECCLE.  \n  \n  \n  \nAbstract \nWe study the impact of horizontal mergers on merging firms’ incentives to invest in demand-enhancing innovation. In our baseline model\, we identify four effects of a symmetric merger on these incentives: the innovation diversion effect\, the margin expansion effect\, the demand expansion effect\, and the per unit return to innovation effect. We offer sufficient conditions for a merger to reduce or raise merging firms’ incentives to innovate in the absence of spillovers and efficiency gains in R&D\, and find that a comparison between the innovation diversion and price diversion ratios is informative about the impact of a merger on innovation. \n  \nThe seminar will take place on the 16th of May from 12.15 to 13.30 pm at the Department of Economics at NHH\, room E209/210.

SUMMARY:Finn/Nettbil saken: Lærdommer fra Høyesteretts dom
Konkurranseklagenemnda ga i mai 2021 Konkurransetilsynet medhold. Opptaket kan sees her. Lysbildene fra innleggene er vedlagt nedenfor. \nErling Hjelmeng \, Frode Steen

SUMMARY:Market investigation tool in Norway?
DESCRIPTION:Market investigation tool in Norway?\n \nIn recent years\, there has been an ongoing debate about new competition law tools that could complement existing competition law tools. In the EU both the Digital Markets Act (DMA) and the Digital Services Act (DSA) have been heavily debated. At the same time there are countries such as Iceland and United Kingdom that already for many years have had a competition tool called “market investigation”. This is a tool that makes it possible to investigate a particular industry\, and propose measures to correct any adverse effect on competition even if there is no established violation of the competition rules. Earlier this year\, the Norwegian Ministry for Industry and Fisheries proposed that the Norwegian Competition Authority should be given the authority to perform market investigations\, similar to the CMA’s model. So far such a new competition tool has not been implemented. The seminar invites to a discussion on the pros and cons of such a new competition tool. To do this\, we have three distinguished speakers: \n\nSenior Director Daniel Gordon\, Competition & Markets Authority\, United Kingdom\nSenior Advisor Hans-Petter Håvås Hanson\, Norwegian Competition Authority\nPartner Kristin Hjelmaas Valla\, Kvale law firm\n\nDaniel Gordon will explain the market investigation tool that has been used in the UK for many years\, while Hans-Petter Håvås Hanson will discuss the main reasons for introducing such a competition tool in Norway. Kristin Hjelmaas Valla will discuss such a competition tool seen from the business society’s perspective. \n\nWhen: Friday October 21\, 10-12 am\nWhere: Auditorium 3\, Faculty of Law\, University of Bergen\n\nThe seminar will also be streamed HERE.

SUMMARY:Er fusjonskontrollen for streng?
Innledere er \n\n\n\n\n\nPartner Heidi Jorkjend\, Advokatfirmaet  Thommessen\nProfessor Eirik Østerud\, Institutt for Privatrett\, Universitetet i Oslo\nProfessor Tommy S. SUMMARY:Joint purchasing of energy in the EU - competition law barriers and geopolitical implications
DESCRIPTION:On the 9th of June\, The Bergen Centre for Competition Law and Economics and the Research Group for Natural Resource Law\, Environmental Law and Development Law hosted a hybrid seminar on joint purchasing of energy with a special focus on competition law barriers and geopolitical implications of joint purchase of gas. \nThere is a public debate now regarding the function that joint gas procurement might play in energy procurement in Europe. This calls for clarification on exactly which problem joint procurement should address\, which entails the scope of gas contracts that would be considered\, economic implications and how implementation might work. \nFor more information about the seminar\, see HERE or check each speaker’s slides (click on the title). The seminar is recorded\, and can be found HERE. \n  \nThe speakers on the seminar were the following: \n\nProfessor Leigh Hancher\, European Law at the University of Tilburg: The joint purchasing options in a moving energy landscape\nAssociate Professor Ignacio Herrera Anchustegui\, Faculty of Law\, University of Bergen:Competition law and joint purchasing of energy\nProfessor Lars Sørgard\, Norwegian School of Economics and BECCLE: Implications of the decisions for energy markets and Norway\nPartner Monica Syrdal\, Hjort law firm: Organizing joint energy purchasing: practical considerations

SUMMARY:Seminar on EU merger control
DESCRIPTION:Tomaso Duso will present his empirical study of EU merger control\, done jointly with Paula Affeldt\, Klaus Gugler and Joanna Piechucka. They analyze more than 1000 mergers scrutinized by the European Commission between 1980 and 2019.  One finding from their study is that they are concerned about the Commission’s merger enforcement being too lax. \nTime: May 24 2022\, 12.15-13.30 \nVenue: Room E209/210\, Norwegian School of Economics \nThis is a joint seminar with Center for Business Economics (CBE) at NHH \n  \nDownload paper here. \n  \nAbstract: Worldwide\, the overwhelming majority of large horizontal mergers are cleared by antitrust authorities unconditionally. The presumption seems to be that efficiencies from these mergers are sizeable. We calculate the compensating efficiencies that would prevent a merger from harming consumers for 1\,014 mergers affecting 12\,325 antitrust markets scrutinized by the European Commission between 1990 and 2018. Compensating efficiencies seem too large to be achievable for many mergers. Barriers to entry and the number of firms active in the market are the most important factors determining their size. We highlight concerns about the Commission’s merger enforcement being too lax.

SUMMARY:Seminar om prisregulering på dagligvarer

SUMMARY:Sustainability and competition law – a conflict?
DESCRIPTION:Professor Maarten Pieter Schinkel \nA more sustainable society is needed to slow down and ultimately reverse the rapid climate change. For firms to become more sustainable\, they are often encouraged to join forces for example by entering sustainability agreements. This triggers the questions of whether the ban on anticompetitive agreements is a problem when faced with these types of climate friendly collaborations\, and if so\, whether competition law should be revised in order to allow for sustainability considerations to be taken into account as possible justifications under the prohibition against anticompetitive agreements. \nBECCLE is pleased to announce a panel of four expert speakers: \n\nProfessor Maarten Pieter Schinkel\, University of Amsterdam (presentation)\nAssociate professor Ronny Gjendemsjø\, Faculty of Law\, University of Bergen (presentation)\nDirector General Tina Søreide\, Norwegian Competition Authority (presentation)\nPartner Siri Teigum\, Thommessen Law Firm\nLawyer Kristoffer Grøndahl\, Thommessen Law Firm (presentation)\n\n  \nTime: Thursday April 7 at 12:15-14:00 \nVenue: Auditorium 4\, Faculty of Law\, University of Bergen (Magnus Lagabøtes Plass 1) \nYou can also follow the seminar on Zoom. SUMMARY:The role of privacy in competition law
DESCRIPTION:Bergen Center for Competition Law and Economics (BECCLE)\, the Research group for EU/EEA Commercial law and the Research group for Information and Innovation law\, are pleased to announce a guest lecture by Ms. Arletta Gorecka\, PhD Candidate in Law at the University of Strathclyde\, Glasgow. In the lecture\, Ms. Gorecka will elaborate on the role of privacy in competition law by presenting two recent cases. The lecture will take place 23. September via Zoom (the link is published below). \n“The relationship between competition law and privacy is still seen as problematic with academics and professionals trying to adequately assess the impact of privacy on the competition law sphere.” Indeed\, it is not difficult to agree with Ms. Gorecka\, whose research is dedicated to the increasingly more interesting interplay between competition law and personal data protection. In June\, Ms Gorecka published a chapter “Is “Privacy” a means to protect the competition or advance objectives of innovation and consumer welfare?” in Maria Tzanou (Ed.)\, Personal Data Protection and Legal Developments in the European Union Hershey\, PA\, IGI Global\, 2020. \nMs. Gorecka will elaborate on the topic by examining two recent cases. The first concerns Facebook\, an online social media and social networking service that does not require any further introduction. On 23 June 2020\, the German Federal Court of Justice (Bundesgerichtshof) provisionally confirmed the allegation of Facebook abusing dominant position as a result of Facebook’s terms of service that allow for the processing and use of user data\, which are collected online outside the Facebook platform. The German Competition Authority (Bundeskartellamt) prohibited Facebook from processing such data without additional consent given by private users. On 23 June the antitrust division of the Federal Court of Justice decided that the Bundeskartellamt’s prohibition can be enforced. \nThe second case concerns the European Commission’s in-depth investigation into the proposed acquisition of Fitbit by Google. Fitbit is an American company active in the development\, manufacturing and distribution of wearable devices (both smartwatches and fitness trackers) and connected scales in the health and wellness sector\, as well as in the supply of related software and services. As provided in the press release\, the Commission is concerned that the proposed transaction would further entrench Google’s market position in the online advertising markets by increasing the already vast amount of data that Google could use for personalisation of the ads it serves and displays. As Executive Vice-President Margrethe Vestager\, responsible for competition policy\, clarified: “The use of wearable devices by European consumers is expected to grow significantly in the coming years. This will go hand in hand with an exponential growth of data generated through these devices. This data provides key insights about the life and the health situation of the users of these devices. Our investigation aims to ensure that control by Google over data collected through wearable devices as a result of the transaction does not distort competition.” \nThe lecture will take place via Zoom. To participate in the lecture\, follow this Zoom link. The Meeting ID is: 615 0939 2478. The password is: 1b927s02.

SUMMARY:Seminar on input price discrimination
DESCRIPTION:BECCLE together with the Department of Economics are pleased to invite you to a seminar with Germain Gaudin (Copenhagen Business School) on Friday January 17. Gaudin will present his paper entitled “Input price discrimination\, demand forms\, and welfare’’ (joint work with Romain Lestage). The paper studies industries in which retailers face asymmetric input prices from their upstream suppliers\, such as the Norwegian grocery market. \nPlease note that the venue is the Department of Economics\, University of Bergen (Fosswinckelsgate 14)\, Seminar room 327 (3rd floor). \nAbstract: “In this paper\, we analyse the effects of input price discrimination by an upstream monopolist selling to firms with various degrees of efficiency. When downstream markets are independent\, we first study whether the upstream monopolist has an incentive to reduce or to increase the relative cost difference amongst downstream firms. Then\, we examine the impact of input price discrimination on output and welfare. A key determinant of the effects of input price discrimination on prices\, output\, and welfare is the sum of demand curvature and pass-through elasticity. We apply our findings to the set of demand forms with constant pass-through rates\, as well as other demand forms. We also discuss the cases of demand asymmetries across markets and price competition downstream”. \n  \n

DESCRIPTION:John Unwing/Unsplash. \n  \n17.

SUMMARY:Seminar on EU state aid regulation
DESCRIPTION:Patric Tomasso/Unsplash. \n  \nThe Research Group for EU/EEA\, Competition and Market Law and Bergen Center for Competition Law and Economics (BECCLE) are pleased to invite you to a seminar with Linda Nyberg\, from the department of political science at Lund University\, Sweden\, on EU state aid regulation. The seminar will take place at the 16th of October\, from 10:00 to 11:30\, in Auditorium 4\, Law Building 1\, at the University of Bergen. \nEver wondered why policymakers seem so convinced that more competition is the solution to all political and economic problems? Or why “free market” reform tends to end up in new forms of bureaucratic government rather than less? This seminar will try to answer these broader questions by focusing on the ideological basis of EU state aid regulation – a set of rules that prevents governments at all political levels from acting in ways that distorts competition. \n \nLinda Nyberg (phd) has a postdoc position at the department of political science at Lund University\, Sweden. Her presentation is a summary of her dissertation Market bureaucracy. Neoliberalism\, Competition and State Aid Policy that can be downloaded from this link. Her current research project focus on bureaucratization and better regulation policy.
